§ 1
General Information

1. This page informs Users of our privacy policy regarding the collection, use and disclosure of Personal Information (“Personal Data”) we receive from customers and users of https://fideltronik.com (hereinafter: the “Site”).  Customers and users shall be referred to collectively as “Users”. Like many website operators, we collect information that users intentionally provide upon filling a contact form or provided by “cookies”.
2. The controller of Personal Data is Fideltronik Poland Sp. z o. o. with the registered seat in Sucha Beskidzka 34-200, Beniowskiego 1, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków – Śródmieście in Kraków, 12th Commercial Department of the National Court Register under KRS No. 0000085589, NIP: 5521298418, with share capital of PLN 5,202,000.00 (hereinafter: the „Controller„).
3. The legal grounds for the processing of Personal Data are:
   1. the necessity to perform a contract to which User is a party or to which User is a representative, or to take action at User’s request, prior to the conclusion of the contract (Article 6(1)(b) of the GDPR) – e.g. placing an order and its performance;
   2. the necessity to fulfil the legal obligation incumbent on the Controller (Article 6(1)(c) of the GDPR) – e.g. payment of tax on the completed agreement;
   3. User’s expressed consent (Article 6(1)(a) of the GDPR);
   4. the necessity for the purposes of the legitimate interests pursued by the Controller (Article 6(1)(f) of the GDPR).
4. The purpose of the processing of Personal Data is:
   1. taking actions aimed at concluding a contract (e.g. handling User’s order and User – Controller communication);
   2. performance of the agreement (e.g. providing services);
   3. conducting marketing activities (e.g. sending newsletters, trade offers, information about promotional actions, competitions and other events) – only if User agrees to them.
   4. protection of the legitimate interests pursued by the Controller.
5. Personal Data will be stored for the time necessary to perform the activities referred to in section 4 above and 7 years after their completion (the limitation period for claims), unless the applicable provisions of law impose on the Controller the obligation or right to store Personal Data for a longer period of time. Personal Data stored for the purposes of sending commercial information and direct marketing will be stored and processed until User withdraws consent to their processing, request to remove or limit their processing, object to their processing and/or request their transfer, or due to the liquidation of the company activity.
6. The Controller collects Personal Data provided voluntarily by the User. Collected Personal Data includes: name, surname, email address and contact telephone number. Users are not obliged to provide these data. Providing these data is not a statutory or contractual requirement. Failure to provide these data may result in inability to take actions aimed at concluding a contract, inability to perform this contract (i.e. placing and executing an order) and take actions related to it, as well as fulfilling legal obligations incumbent on the Controller.
7. The recipients of Personal Data are: entities cooperating with the Controller in the scope of the Controller’s activity (Fideltronik SA, Fideltronik Zbigniew Fidelus, Fitech sp.z o.o.); entities providing services to the Controller’s (e.g. accountants, IT, legal, capital group members), state authorities.

§ 2
Data change or cancellation

1. Users have the right to:
   1. withdraw consent at any time (but this does not affect the lawfulness of the processing of Personal Data before withdrawing consent and the lawfulness of the processing of Personal Data on legal grounds other than consent);
   2. object to the processing of their Personal Data;
   3. demand access to his/her Personal Data, rectification and erasure of his/her Personal Data and demand limitation of the processing of his/her Personal Data and their transfer;
   4. file a complaint to the supervisory authority (the President of the Office for Personal Data Protection).
2. In order to exercise User’s rights please contact the Controller by sending an email to sales@fideltronik.com. Upon User’s request the Controller will process User’s request within 30 days of receiving User’s message and inform the User about Controller’s activities in a separate e-mail sent to the e-mail address indicated in the form.

§ 3
Security and storage of Personal Data

1. For the security of entrusted Personal Data, internal procedures and recommendations have been developed to prevent unauthorized access to Personal Data. the Controller monitors performance and constantly validates their compliance with the provisions of the Personal Data Protection Law and executive acts. A secure communication encryption protocol (SSL) is also used.
2. The Controller follows strict security procedures to ensure that User’s Personal Data is not damaged, destroyed, or disclosed to a third party without User’s permission and to prevent unauthorized access to it. Devices storing Personal Data are kept in a secure facility with restricted physical access and we use secure firewalls and other measures to restrict electronic access.
3. All of the Personal Data we collect or record is restricted to the Controller’s offices. Only employees who need the information to perform a specific job are granted access to the User’s Personal Data.

§ 4
Use of cookies

1. Our Site uses cookies. The parameters allow to read information contained in them only to the server that created them. Cookies allow the use of previously visited websites.
2. Our cookies do not identify nor contain any Personal Data. Cookies cannot read information from User’s computer or interact with other cookies on User’s hard drive.
3. The information collected relates to the IP address, type of browser used, language, type of operating system, Internet service provider, time and date, location and information sent to the website via the contact form.
4. The collected Personal Data is used to monitor the use of our Site to improve its functioning, ensuring more effective and problem-free navigation. We monitor information about the user through Google Analytics, which records user’s behavior on the Site. Users can opt out from being tracked by Google Analytics with effect for the future by downloading and installing Google Analytics Opt-out Browser Addon for User’s current web browser: https://tools.google.com/dlpage/gaoptout?hl=en
5. On our Site we use the following cookies:
   1. „Performance” cookies, enabling the collection of information about the use of the Site;
   2. „Functional” cookies, allowing „remembering” the settings selected by the user and personalizing the user’s interface, e.g. in terms of the language or region the user comes from, the size of the font, the appearance of the website, etc.;
6. Users may refuse the use of cookies by selecting the appropriate settings on User’s browser, however please note that it may limit full functionality of this website.

§ 5
Final provisions

1. The Controller reserves the right to make changes to the Privacy Policy, which may be affected by the development of Internet technology, possible changes to the provisions of the Personal Data Protection Law and the development of the website and Services provided by the Controller. The Controller will inform Users about any changes in a visible and understandable way.
2. On our Site, the links to other websites may appear. Such websites operate independently of the Controller and are not in any way supervised by the Controller of Personal Data. These sites may have their own privacy policies and regulations that we recommend to read.

Informacje ogólne

1. Ta strona informuje Użytkowników o naszej polityce prywatności dotyczącej zbierania, wykorzystywania i ujawniania Danych Osobowych („Dane Osobowe„), które otrzymujemy od klientów i użytkowników strony https://fideltronik.com (dalej: „Strona„) . Klienci i użytkownicy będą określani zbiorczo jako „Użytkownicy„. Podobnie jak wielu operatorów stron internetowych, zbieramy informacje, które użytkownicy celowo dostarczają, wypełniając formularz kontaktowy lub dostarczając pliki „cookie”.
2. Administratorem danych osobowych jest Fideltronik Poland Sp. z o. o. z siedzibą w Suchej Beskidzkiej 34-200,ul. Beniowskiego 1, wpisana do Rejestru Przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla Krakowa – Śródmieście w Krakowie, XII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000085589 , NIP: 5521298418, o kapitale zakładowym 5 202 000,00 PLN (dalej: „Administrator„).
3. Podstawą prawną przetwarzania danych osobowych są:
   1. konieczność wykonania umowy, do której Użytkownik jest stroną lub do którego należy Użytkownik, lub do podjęcia działań na żądanie Użytkownika, przed zawarciem umowy (art. 6 ust. 1 lit. b) RODO) – np. składanie zamówienia i jego wykonanie;
   2. konieczność wypełnienia obowiązku prawnego spoczywającego na administratorze (art. 6 ust. 1 lit. c) RODO) – np. zapłata podatku od zrealizowanej umowy;
   3. wyrażona przez użytkownika zgoda (art. 6 ust. 1 lit. a) RODO);
   4. konieczność spełnienia uzasadnionych interesów przez administratora (art. 6 ust. 1 lit. f) RODO).
4. Celem przetwarzania danych osobowych jest:
   1. podejmowanie działań zmierzających do zawarcia umowy (np. obsługa zamówienia Użytkownika i komunikacja Użytkownik – Administrator);
   2. wykonanie umowy (np. świadczenie usług);
   3. prowadzenie działań marketingowych (np. wysyłanie biuletynów, ofert handlowych, informacji o akcjach promocyjnych, konkursach i innych wydarzeniach) – tylko wtedy, gdy Użytkownik się na nie zgodzi;
   4. ochrona uzasadnionych interesów realizowanych przez administratora.
5. Dane osobowe będą przechowywane przez czas niezbędny do wykonania czynności, o których mowa w ust. 4 powyżej i 7 lat po ich zakończeniu (okres przedawnienia roszczeń), chyba że obowiązujące przepisy nakładają na administratora obowiązek lub prawo do przechowywania danych osobowych przez dłuższy czas. Dane osobowe przechowywane w celu przesyłania informacji handlowych i marketingu bezpośredniego będą przechowywane i przetwarzane, dopóki Użytkownik nie wycofa zgody na ich przetwarzanie, nie zażąda usunięcia lub ograniczenia ich przetwarzania, nie zgłosi sprzeciwu do ich przetwarzania i / lub nie zażąda ich przeniesienia lub nie zostanie zlikwidowana działalność firmy.
6. Administrator gromadzi Dane osobowe podane dobrowolnie przez Użytkownika. Zgromadzone Dane Osobowe zawierają: imię, nazwisko, adres e-mail i numer telefonu kontaktowego. Użytkownicy nie są zobowiązani do podania tych danych. Podanie tych danych nie jest wymogiem ustawowym ani umownym. Niedostarczenie tych danych może skutkować brakiem możliwości podjęcia działań zmierzających do zawarcia umowy, niemożnością wykonania tego zamówienia (tj. złożeniem i wykonaniem zlecenia) i podjęciem z tym związanych czynności, a także wypełnieniem obowiązków prawnych spoczywających na Administratorze.
7. Odbiorcami Danych Osobowych są: podmioty współpracujące z Administratorem w zakresie działalności administratora (Fideltronik SA, Fideltronik Zbigniew Fidelus, Fitech sp.z o.o.); podmioty świadczące usługi na rzecz administratorów (np. księgowi, informatycy, prawnicy, członkowie grup kapitałowych), organy państwowe.

§ 2
Zmiana lub anulowanie danych

1. Użytkownicy mają prawo:
   1. w każdej chwili wycofać zgodę (nie ma to jednak wpływu na zgodność z prawem przetwarzania danych osobowych przed cofnięciem zgody i legalności przetwarzania danych osobowych na podstawie prawnej innej niż zgoda);
   2. sprzeciwiać się przetwarzaniu ich danych osobowych;
   3. żądać dostępu do swoich Danych Osobowych, poprawiania i usuwania swoich Danych Osobowych i żądać ograniczenia przetwarzania swoich Danych Osobowych i ich transferu;
   4. złożyć skargę do organu nadzoru (Prezesa Urzędu Ochrony Danych Osobowych).
2. W celu skorzystania z praw Użytkownika, należy skontaktować się z Administratorem wysyłając wiadomość e-mail na adres: sales@fideltronik.com. Na żądanie użytkownika Administrator przetwarza żądanie Użytkownika w ciągu 30 dni od otrzymania wiadomości Użytkownika i informuje Użytkownika o działaniach Administratora w osobnym e-mailu wysłanym na adres e-mail wskazany w formularzu.

§ 3
Bezpieczeństwo  i przechowywanie danych osobowych

1. W celu zapewnienia bezpieczeństwa powierzonych danych osobowych opracowano wewnętrzne procedury i zalecenia w celu zapobiegania nieautoryzowanemu dostępowi do danych osobowych. Administrator monitoruje wydajność i stale potwierdza ich zgodność z przepisami ustawy o ochronie danych osobowych i aktami wykonawczymi. Stosowany jest również bezpieczny protokół szyfrowania komunikacji (SSL).
2. Administrator postępuje zgodnie ze ścisłymi procedurami bezpieczeństwa, aby zapewnić, że dane osobowe użytkownika nie zostaną uszkodzone, zniszczone lub ujawnione stronom trzecim bez zgody użytkownika oraz w celu uniemożliwienia nieupoważnionego dostępu do nich. Urządzenia przechowujące dane osobowe są przechowywane w bezpiecznym pomieszczeniu o ograniczonym fizycznym dostępie, używamy bezpiecznych zapór ogniowych i innych środków w celu ograniczenia dostępu elektronicznego.
3. Wszystkie dane osobowe, które zbieramy lub rejestrujemy, są ograniczone do biur administratora. Tylko pracownicy, którzy potrzebują informacji do wykonania określonej pracy, mają dostęp do danych osobowych użytkownika.

Używanie plików cookie

1. Nasza strona wykorzystuje pliki cookie. Parametry pozwalają odczytać zawarte w nich informacje tylko serwerowi, który je utworzył. Pliki cookie umożliwiają korzystanie z wcześniej odwiedzanych stron internetowych.
2. Nasze pliki cookie nie identyfikują ani nie zawierają żadnych danych osobowych. Pliki cookie nie mogą czytać informacji z komputera użytkownika ani wchodzić w interakcje z innymi plikami cookie na twardym dysku użytkownika.
3. Zebrane informacje dotyczą adresu IP, rodzaju używanej przeglądarki, języka, rodzaju systemu operacyjnego, dostawcy usług internetowych, czasu i daty, lokalizacji oraz informacji przesyłanych do witryny za pośrednictwem formularza kontaktowego.
4. Zebrane Dane Osobowe są wykorzystywane do monitorowania użytkowania naszej Witryny w celu poprawy jej funkcjonowania, zapewniając skuteczniejszą i bezproblemową nawigację. Monitorujemy informacje o użytkowniku za pomocą Google Analytics, który rejestruje zachowanie użytkownika w Witrynie. Administrator będzie informował Użytkowników o wszelkich zmianach w widoczny i zrozumiały sposób.
2. Na naszej stronie mogą pojawiać się linki do innych stron internetowych. Takie strony działają niezależnie od administratora i nie są w żaden sposób nadzorowane przez administratora danych osobowych. Witryny te mogą mieć własne zasady i przepisy dotyczące prywatności, które zalecamy przeczytać.
